Vietnam is a member of PCT therefore filing of PCT National phase patent application is possible in Vietnam. Deadline to file PCT national phase application in Vietnam is 31 months from the earliest priority date.

Additionally, patent applications can also be filed in Vietnam under Paris Convention claiming priority from foreign countries. Timeline to file a patent application under Paris convention is 12 months from the priority date.

Vietnam patent office also grants Petty Patents for minor/improvement inventions. Maximum term of a Petty Patent is 10 years. Annual annuity fee is required to maintain the Petty Patent for the maximum term of 10 years.

Timeline for filing trademark and design applications in Vietnam claiming priority from foreign application under Paris Convention is 6 months from the priority date.

Vietnam is a member of Madrid Protocol. Our firm handles provisional refusal by Vietnam Trademark Office for International trademark applications designating Vietnam.

Translation of the application in local language is required. We take care of the translation of the applications from English to local language at our end.

A Power of Attorney and certified copy of priority document is required but filing of these documents at the time of filing the application is not mandatory and these documents can be filed later also.
